These Terms of Service ("Terms") govern your use of the Violation Leads service and website at violationleads.com. By creating an account, you agree to these Terms in full.

1. Service Description

Violation Leads is a lead generation service that monitors public municipal code enforcement databases and delivers alerts to subscribed contractors when violations matching their trade and service area are filed. All lead data is sourced from public government records.

2. Account Terms

To use the service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized account access

You are responsible for all activity that occurs under your account. You may not share account access with others or create accounts to circumvent plan limits.

3. Acceptable Use

You agree to use Violation Leads leads only for legitimate business development purposes - specifically, to contact property owners about services to remediate code violations. You agree not to:

  • Use lead data for any purpose other than legitimate contractor outreach
  • Harass, threaten, or deceive property owners
  • Resell or redistribute lead data to third parties
  • Use automated systems to contact leads in violation of applicable telemarketing laws (TCPA, CAN-SPAM)
  • Make false representations about your credentials or the violations when contacting property owners

You are solely responsible for complying with all applicable laws when contacting property owners, including TCPA, state-level telemarketing regulations, and Do Not Call registry requirements.

4. Data Accuracy Disclaimer

Lead data is sourced from public government records and is provided as-is. We do not guarantee the accuracy, completeness, or timeliness of any lead data. Violations may be closed, appealed, or modified after we capture them. Property owner contact information is sourced from public property records and may not always be current.

We are not liable for any outcomes resulting from your use of lead data, including failed contact attempts, legal disputes with property owners, or failure to close any business opportunity.

5. Payment Terms

Paid subscriptions are billed monthly or annually in advance. All payments are processed by our payment processor. Prices are subject to change with 30 days notice.

Pro plan refund policy: If you are not satisfied within your first 14 days of a paid Pro subscription, contact us for a full refund of your first month's payment. After 14 days, no refunds are issued for the current billing period.

Annual subscriptions: Annual plans are non-refundable after 30 days. Within 30 days, a prorated refund may be issued at our discretion.

Free plan: The free plan is provided without cost and may be modified or discontinued at any time.

6. Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation, your paid access continues until the end of your current billing period. No partial refunds are issued for the remaining billing period after cancellation, except as described in our refund policy above.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIOLATION LEADS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR LEAD DATA. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Intellectual Property

The Violation Leads service, website, and all associated content are owned by Violation Leads and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our service or content without our express written permission.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or cause harm to our service or other users. In cases of clear Terms violation, we may terminate without refund.

10. Changes to Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the state of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court for intellectual property infringement.
